Objet<\/b><\/h2><p><span style=\"font-weight: 400;\">Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales d\u2019Utilisation (ci-apr\u00e8s \u00ab\u00a0CGU\u00a0\u00bb) r\u00e9gissent l&rsquo;utilisation des services propos\u00e9s par ENCUBE, incluant :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le terminal de paiement \u00e9lectronique intelligent (ci-apr\u00e8s \u00ab\u00a0TPE Encube\u00a0\u00bb)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019application mobile ENCUBE<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les services (back-office, analytics, synchronisation)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les fonctionnalit\u00e9s e-commerce (cr\u00e9ation de boutique, g\u00e9n\u00e9ration de lien de paiement)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les abonnements mensuels ou annuels<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">L\u2019utilisation des Services ENCUBE implique l\u2019acceptation sans r\u00e9serve des pr\u00e9sentes CGU.<\/span><\/p><h2><b>2. Description des services<\/b><\/h2><p><span style=\"font-weight: 400;\">ENCUBE propose aux commer\u00e7ants, ind\u00e9pendants et PME une solution compl\u00e8te incluant :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un TPE mobile tout-en-un (paiement, impression ticket, scanner)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une application mobile (Android) de gestion des ventes, clients et stocks<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Des services s\u00e9curis\u00e9s (sauvegarde, synchronisation, analyse)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une interface Web pour la cr\u00e9ation de boutique en ligne<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Des modules d\u2019encaissement (Mobile Money, carte bancaire, esp\u00e8ces)<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">ENCUBE peut \u00eatre utilis\u00e9 en mode <\/span><b>abonnement mensuel<\/b><span style=\"font-weight: 400;\">, avec ou sans engagement, ou en formule gratuite avec acc\u00e8s limit\u00e9 aux fonctionnalit\u00e9s.<\/span><\/p><h2><b>3. Acc\u00e8s et compatibilit\u00e9<\/b><\/h2><p><span style=\"font-weight: 400;\">Le service ENCUBE est accessible :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">via l\u2019application mobile ENCUBE (Android)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">via le terminal ENCUBE (syst\u00e8me propri\u00e9taire)<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">via l\u2019espace client en ligne : <\/span><a href=\"https:\/\/www.encube.sn\/en\/\"><span style=\"font-weight: 400;\">encube.sn<\/span><\/a><\/li><\/ul><p><span style=\"font-weight: 400;\">L\u2019utilisateur est responsable de disposer d\u2019un terminal compatible, d\u2019un acc\u00e8s internet (sauf en usage offline), et de la mise \u00e0 jour r\u00e9guli\u00e8re de son application.<\/span><\/p><h2><b>4. Cr\u00e9ation de compte<\/b><\/h2><p><span style=\"font-weight: 400;\">L\u2019acc\u00e8s aux services ENCUBE n\u00e9cessite la cr\u00e9ation d\u2019un compte utilisateur via :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le formulaire d\u2019inscription sur le terminal ou l\u2019application<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La validation d\u2019une adresse email ou num\u00e9ro de t\u00e9l\u00e9phone<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le choix d\u2019un abonnement (gratuit ou premium)<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">L\u2019utilisateur s\u2019engage \u00e0 fournir des informations exactes et \u00e0 jour.<\/span><\/p><h2><b>5. Paiements &amp; abonnements<\/b><\/h2><p><span style=\"font-weight: 400;\">ENCUBE propose plusieurs formules :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Free <\/b><span style=\"font-weight: 400;\">: Jusqu&rsquo;\u00e0 10 produits, 20 commandes par mois, 10 liens de commande gratuits, Statistiques compl\u00e8tes<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Premium <\/b><span style=\"font-weight: 400;\">: <\/span><span style=\"font-weight: 400;\">Unlimited access to all modules of the application<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Encube System<\/b><span style=\"font-weight: 400;\"> : Acc\u00e8s illimit\u00e9 \u00e0 tous les modules de l\u2019application, Mise \u00e0 disposition d\u2019un TPE Encube System, Mise \u00e0 disposition de 3 rouleaux de papier d&rsquo;impressions<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Le paiement s\u2019effectue par carte bancaire, Mobile Money ou cash de mani\u00e8re s\u00e9curis\u00e9e.<\/span><\/p><h2><b>6. Utilisation du terminal ENCUBE<\/b><\/h2><p><span style=\"font-weight: 400;\">L\u2019utilisateur s\u2019engage \u00e0 :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utiliser le TPE Encube conform\u00e9ment \u00e0 sa documentation<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ne pas sous-louer, revendre ou d\u00e9tourner l\u2019appareil<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Maintenir le TPE en bon \u00e9tat (voir conditions de garantie)<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">En cas de perte, vol ou panne non couverte, des frais de remplacement peuvent s\u2019appliquer.<\/span><\/p><h2><b>7. R\u00e9siliation et suspension<\/b><\/h2><p><span style=\"font-weight: 400;\">L\u2019utilisateur peut r\u00e9silier son compte \u00e0 tout moment depuis l\u2019espace client.<\/span><\/p><p><span style=\"font-weight: 400;\">ENCUBE se r\u00e9serve le droit de suspendre ou r\u00e9silier un compte en cas de :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fraude ou suspicion de fraude<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-respect des pr\u00e9sentes CGU<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Comportement illicite ou abusif<\/span><p>\u00a0<\/p><\/li><\/ul><h2><b>10. Limitations de responsabilit\u00e9<\/b><\/h2><p><span style=\"font-weight: 400;\">ENCUBE ne saurait \u00eatre tenu responsable en cas de :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pertes de donn\u00e9es dues \u00e0 une mauvaise utilisation<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pannes li\u00e9es \u00e0 une connexion Internet instable<\/span><p>\u00a0<\/p><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u00e9faillances dues \u00e0 un usage non conforme du TPE<\/span><p>\u00a0<\/p><\/li><\/ul><p><span style=\"font-weight: 400;\">ENCUBE garantit une assistance technique dans des d\u00e9lais raisonnables.<\/span><\/p><h2><b>11. \u00c9volutions des CGU<\/b><\/h2><p><span style=\"font-weight: 400;\">ENCUBE peut modifier les pr\u00e9sentes CGU \u00e0 tout moment.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> L\u2019utilisateur sera notifi\u00e9 par email ou via l\u2019application.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> La poursuite de l\u2019utilisation des services vaut acceptation des nouvelles CGU.<\/span><\/p><h2><b>12.
